The following summary is from one of sixty-six Clean Water Act Prosecutions in Louisiana since 1990
Fiscal Year 2000 Case ID# CII-23633
$800,000 in federal fines and restitution for one charge under the CWA
A bulk liquids tank rental/storage company was charged and pled guilty to knowingly violating the Clean Water Act. The employees took samples at “unlawfully prescribed” locations, and submitted these as legitimate samples representing their outfall, or effluent release. The company was sentenced to pay $400,000 in restitution, which went to the State Police, Southern Environmental Enforcement Network and US Fish and Wildlife Fund. Further, the company was charged a $400,000 fine, required an environmental audit annually and was ordered to provide annual employee training on environmental laws.
