San Diego metal-plater imprisoned two years for CWA violations

One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)

The defendants in this case are a San Diego metal plating company and its owner. The business was regulated under state and national discharge permit system based on the pretreatment standards for metal finishers to ensure compliance with the Clean Water Act.

The defendants were known to the local wastewater treatment plant and the City of San Diego for violation of pretreatment permit limits for copper, zinc nd other heavy metals over many years. In addition to discharging non-compliant waste, this company had been cited for failure to monitor effluent characteristics of the discharges.

Federal district court in California presented 25 charges of Clean Water Act violations by the company and its principal. The defendants were convicted at trial on 24 counts of unlawful discharge of pollutants. Sentencing included incarceration of the owner, matching federal fines for the owner and corporation at $5,000 per conviction and a period of probation.

Prison: 24 months; Federal Fine: $240,000; Special Assessment: $8,400, Probation: 12 months
