Historic Conviction Fiscal Year 2012; Case ID# CR_2281 (Louisiana)
This oil and gas producer claimed a perfectly clean operation. An employee flagged the anomaly, resulting in a CWA conviction.
The Defendant in this case was a contractor, responsible for the day-to-day operation of an oil and gas platform anchored down in Breton Sound, off the Louisiana Gulf coast. The owner of the platform, Lindor Oil, relied upon the contracted operator to follow applicable environmental laws, protecting the waters of the Gulf.
In early summer 2007, an employee of Lindor Oil made note of a gap in the production records for the Defendant's operations one year prior. The Defendant had no produced wastewater to declare, no record of the waste barge removing the oily brine solution normally associated with oil and gas extraction. A Lindor Oil supervisor queried the Defendant, who claimed the well was producing clean, with no produced wastewater.
Following an investigation by US EPA Criminal Investigation Division, the Defendant plead guilty to violating the Clean Water Act. The Defendant admitted to ordering the produced wastewater dumped overboard, into Breton Sound. The guilty plea was received at the Federal District Court in Louisiana; the sentence included a federal fine and three years of court supervision.
