Operator convicted for faking WWTP compliance responsibilities

One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)
The defendant in this case is an individual who was solely responsible for environmental compliance duties for two municipal wastewater treatment plants in California. The compliance activities involve monitoring and reporting water quality of the effluent discharged. The defendant submitted compliance reports as though the water quality testing for both facilities was properly carried out at an on-site laboratory located in one of the wastewater treatment plants.
Investigators learned that the WWTP laboratory license had expired nearly a decade earlier, in 1998. Further, the monitoring and reporting submissions for both WWTP facilities was deemed fraudulent.
A bill of information presented to the Federal District Court in California supported 6 counts of mail fraud and 6 violations of the Clean Water Act. The defendant plead guilty to all 12 counts.
The defendant was spared a federal fine, sentenced to two years of probation, 100 hours of community service and a $150 dollar special assessment.
